Subject: 360 Air Intakez Knock-off on eBay? IP: Logged
Message: I was browsing eBay for Dakota stuff and came across this bid:
eBay AEN Intake Bid
Since I'm also in the market for a new air intake, I looked at the bid in more detail. Hmmm, that intake sure looks an awful lot like the 360 Air Intakez version. Then I looked at the last picture on the bid. Apart from some minor editing in Photoshop, that image was taken straight from the 360 Air Intakez site.
I emailed the seller to inquire about the similarities. Here's the response:
Question: "Is this intake made by "360 Air Intakez"? It looks identical to the one on
their website:

Response: "Oh! where did you find the picture? The engine is 4.7. It is same my intake.
But the filter is different.
About the third picture that is my car's intake and engine.
Are you interesting to buy my intake, please reply me?"
Engrish at its finest!
What to you guys think?

Message: different color fluid caps, oil dipstick, washer fluid. A/C lines are a different color too. Just an observation. Could have been the way it scanned. Who knows. Send the picture to 360 and see what he thinks. Oh yeah and tell him to put a heat sheild on his intake for the 4.7L. Then I might upgrade from old 3" to new 3.5"

Message: That isn't even a K&N filter. You can buy that filter for 8 bucks at my local auto parts store. It is a 2 piece also, notice the 2 clamps on the intake, 1 for throttle body and 1 for the middle pieces. He is making them and selling them. Notice the advertising, he resorts to HP gain 3 or 4 times in a 5 sentence section. It's false. Buy a K&N.

Message: CThomp, the different color fluid caps are a dead giveaway. Notice that everything yellow in the original image was changed to white in the modified image - washer fluid cap, oil filler cap, dip stick handle. Very easy Photoshop trick - change everything of a certain color into something else. Changing the A/C lines color is also very easy. Draw a selection around the lines and change the color. Also, look at the reflections of the A/C lines on the intake tube. That should be blue as well. However, they're silver. The scammer forgot to edit that! Dumb arse!
By the way, I did send an email to 360 Air Intakez and referenced this thread.

Message: Wow, that was quick. I just got a response from Joe Boblett, owner of 360 Air Intakez:

Thanks for the heads up on the intake. It looks like someone got a hold of our intake system and is reproducing it overseas. This kind of thing happens all the time. But luckily we have copyright laws in place to help in a situation like this. I have contacted the seller about the copyright infringement and that I will take legal action against those responsible. Also I feel sorry for the guy that buy's that system because the little air filter is not going to flow enough air for the engine. It will but allot of strain on the engine, resulting in engine damage.

Message: Colors changed and stretching the image to mask a copied photo to RRIIP off people.Who can you trust these days. Good eye on noticing the reflection on the tube. Hopefully this guy was unmasked before he sold any of these things. Especially since after picking up a filter and a trip to a home improvement store anyone can put one of these together for nickles on the dollar compared to what he's charging.
And that's my 2 cents worth.
By the way it looks like this character has changed the photos to hock his junk.

Message: hate to burst your rat bubble but if a piece of work has been changed/modified by 20% or more it's "new" .. meaning if this guy (based on the exact picture above) moved/changed/edited more than 191 pixels (image > 959px X .2 = 191.8) on the original shot then it's "new" original work. Even though our eyes pick it up as the same, the data has changed entirely. I am the a.d. at creative solutions and run my own side op at figit.com .. I know this because it's happened to me. I designed a trade-show booth for homes.com, passed it around the design community for feedback and next thing you know, realtor.com (owned my microshaft) showed up to a large dc conference with basically a replica of my own (homes.com) booth but with enough diff. to clear them. Ever heard of the phrase "good artist borrow, great artist steal..." They DID not invest in attourneys either so it was no hard fought battle that homes.com had to fold over, the judge threw it away b/c of the 20% rule ... if both this dude on ebay and the makers of the 360 both live in the sticks then maybe 360 could win a case based on his uncles brothers mothers testimony but other than that no way. Lesson learned here is NOT that the cat on ebay is a ripper, 360 are bastids' for pushing WAAAAY overpriced materials so good find Andrew!
Oh and Joe Boblett is amazing, you don't/can't/never have/or never will be able to "copy right" material goods! NEVER ... Joe needs to learn the diff. between trademarking and copyrighting unles joe's intakes are made of paper mache' articles, books, journals, photocopies, library reserves, printed Web sites, or printed e-mails then mr. joe here has wasted a great deal of money on "copyrighting" his work.
So .. go nab a k&n cone filter (because it says k&n) then go nab this guy on ebays pipes .. you'll still be way under joe's setup.

Why do you think it's worth it?
The whole point is that some one stole a design because they couldn't do it them self's. If you feel Joe is charging to much for his products then that's your opinion. I feel your asking to much for your services! $35-60/hr
Did you factor in labor cost, advertising, and other business expenses.
Also Joe never mentioned copyrighting material goods, that's what you assumed. If you re-read it again you will see that he is talking about the picture.

Do you think they are bastids' for pushing WAAAAY overpriced materials too?
Then why did you buy it?

Message: That intake was designed by us 360 and we started selling these systems to businesses, but that air filter was not ours. In the coming months you will see more of our designs on the market. We are currently re-designing this intake system and our Ram 4.7L system.

Message: Igitdotcom I think your comments are way out of line. For one thing your childish name calling for was totally uncalled for. Also you are saying that it is okay to steal someone else's design just because you think it is over priced. That is the logic that looters use during a riot to justify smashing in windows and running off with TV's. "Hay it was over priced anyway, he had it coming".
I agree with NosRT, I think you should only charge $15 per hour to avoid being seen as WAAAY over priced to the guy who makes $6 per hour sweeping up after you in your office. I have to say that you posting your business web address along with that kind of thinking might not be very good for business.
I guess my point is, if you don't like Joe's product that’s your right, and you can go right out and something that is cheaper that will likely not work as well. Torching him on this forum, calling him names and advocating that people buy a rip-off of his design and go and buy a different air filter to make it usable is over the line. You are in effect advocating theft and suggesting that others give the money to someone who did nothing except to take an excellent design and copy it with no added value; in fact they are now selling something that could actually damage an engine. Nice guy.

Message: oh no way guys I have no probs with Joe or his intake AT ALL! Actually it's about the nicest looking intake on the market in my opinion, my point is I have been burned and know how it goes so it's a waste of time and money to pursue these things in most cases, if your product is mass-produced go back to the drawing boards and create another outstanding release which will put you back on top and keep the dogs away for another 6 months know what I mean? .. As far as my pricing goes 35-65 is VERY good for advanced action scripting, SQL work, .net development etc.. here at work they charge 150/hr for this stuff. I've been in the field for 8 years so in no way are my rates unfair in fact if an electrition was at his/her trade for 8 years they'd make about the same. Hey, sorry if I offended anyone and Joe if you want to protect your images just have your designer use a little javascript or have him design and upload just your images in flash with the "protect from import" command set upon exporting AND have him set up a global variable that looks for the "alt or print screen" key button being pressed, on a press have him throw a blank white frame in so that the thiefs clip-board will only have a blank white box where he/she thought the image would be. That way they cant right-click, pull up from there cache, nor take a screen-shot of the image. This is very easy so if you or your go to guy needs help send me an email!

Message: Just so you know I never thought that $65 an hour was out of line for your line of work, I was just a little tweeked about your earlier comments and was making a point.
I know Joe personally and know how hard he works to make a good product and the entire ebay thing kind of set me off.
I apprciate your most receint comments and I will check out that java script stuff for myself as one of the things I do is work in the professional photography field and I need to post my images on teh web and it has been an issue for me personally.

Message: hey scott in your case you may want to invest in a viewer which acts like a plugin, THOSE are rock solid... most stock photo houses use them but they are a few hundred bucks and the end user must install a plugin so that the only way they can see your images are using the plugin which is a very strong deterent b/c it shuts down most of the functionality that would enable a viewer to steal something, good news is a reboot or relaunch of the browser is not needed on them, they are quick. anyhow, yeah man it's all good I think his intakes are super hot man. I hate ricers but his intake has that import polished to perfection look both construction and look wise. again, I hate ricers and DON'T have a wing on my truck nor the 20hp yellow sticker mod heh.. don't want anyone to get the wrong idea, his intake just looks nice and refined.

Message: I've seen Joe make his intakes in person and have used multiple revisions of his intake over the past 18 months. He cuts his own tubes, makes his own heat shields, powdercoats everything himself, etc. All of his filters in the past have been genuine K&N filters, and now he's starting to use S&B filters which dyno better than K&N and have been used in the air intake market for quite some time.
I currently have a 360 Air Intakez kit with 9" x 3.5" filter, 3.5" tube and the aluminum heat shield and love it both for its looks and performance.
Sure there's other options that cost different prices... Pay $220+ for a K&N FIPK that cracks right and left, pay $50 for some PVC pipe and look like MacGyver built it, etc... But you can't compare some cheap plastic POS you find over the counter at Pep Boys to the 360 Intake.

Message: I happened to be looking around e-bay tonight and came across this guy STILL selling these air intakes. I hadn't seen this thread yet and was really thinking about buying when I desided to do a search and this thread came up. Thanks guys, saved me from buying some junk. I guess the moral of the story is there's no cheap way out.
